These terms govern your use of the sendmerlin.com website and the SendMerlin application at app.sendmerlin.com. By creating an account you agree to them.
The service
SendMerlin is an email marketing platform: you manage subscriber lists, design campaigns, and send them to people who gave you permission to email them. AI features draft and review content; you remain responsible for everything you approve and send.
Acceptable use
You may only email recipients who have given you consent. Purchased, rented, or scraped lists are not allowed. Double opt-in is the default and every email must keep its unsubscribe link. We may pause sending or suspend accounts that generate excessive bounces or spam complaints, or that send unlawful, deceptive, or harmful content.
Accounts and sending approval
New workspaces can use the full application immediately; campaign sending is enabled after your sending domain is verified and the workspace is approved. This protects deliverability for every customer.
Fees
Paid plans are billed monthly at the price shown at purchase. Prices are flat per plan tier, not per contact. You can cancel at any time, effective at the end of the billing period.
Refunds
You can cancel your subscription at any time and keep access until the end of the paid period. We do not issue prorated refunds for unused time. If a billing error occurs on our side, we refund the incorrectly charged amount within 14 days of your report to support@sendmerlin.com.
Your content and data
Your lists and campaign content remain yours. You warrant that you have the right to use the addresses you import and that your use complies with applicable law, including the GDPR and local e-privacy rules. Our handling of personal data is described in the privacy policy.
Availability and liability
We aim for high availability but the service is provided "as is" without warranty of uninterrupted operation. To the extent permitted by law, our liability is limited to the fees you paid in the twelve months before the claim.
Changes
We may update these terms; material changes will be announced by email or in the application. Continued use after a change means acceptance.
